This privacy policy applies to the website parkwaerter.de and the iOS app Parkwärter. It explains what data is collected, why, and what rights you have.

2. Hosting

This website is hosted by OVH. When you visit the website, technical data is automatically collected by the web server (so-called server log files). This includes:

  • IP address of the requesting device
  • Date and time of access
  • Page or file accessed
  • Browser and operating system used
  • Referrer URL (previously visited page)

This data is collected for technical reasons and to protect against misuse. It is not merged with other data sources. The legal basis is Art. 6(1)(f) GDPR (legitimate interest in secure operation of the website).

3. Contact Form

When you use the contact form on the website, your name, email address, and message are forwarded to me by email. The data is not stored in a database. I use your information solely to process your inquiry.

The legal basis is Art. 6(1)(b) GDPR (performance of pre-contractual measures) or Art. 6(1)(f) GDPR (legitimate interest in responding to inquiries).

This website integrates the following external resources:

Tailwind CSS (CDN)

Tailwind CSS is loaded via a content delivery network (cdn.tailwindcss.com) for the visual presentation of the website. This establishes a connection to Tailwind Labs servers, during which your IP address is transmitted. The legal basis is Art. 6(1)(f) GDPR (legitimate interest in an appealing presentation of the website).

Google Fonts

This website uses fonts from Google Fonts, loaded from Google servers (fonts.googleapis.com). This establishes a connection to Google servers, during which your IP address is transmitted. Google may process this data in the USA. The legal basis is Art. 6(1)(f) GDPR (legitimate interest in a consistent visual presentation).

App

5. Location Data

The app accesses your location only when an arrival is detected. Your location is sent to my server to check whether a parking disc is required at that location. The result is then stored on your device. When you submit feedback about a parking space, the associated parking reference (not your current location) is also sent to the server.

There is no continuous tracking. Your location is not recorded on an ongoing basis and is not used for any other purposes.

The legal basis is Art. 6(1)(b) GDPR (performance of a contract -- the location check is the core function of the app).

6. Motion Data

In automatic mode, the app uses motion data (e.g., whether you were driving or walking) to determine if you arrived by car. This data is processed exclusively on your device and is never sent to a server.

7. Device Identification

For authentication with my server, an anonymized device ID is used. This is a cryptographic hash value that does not allow any conclusions about you as a person. Neither your name, email address, nor any other personal data is transmitted.

The legal basis is Art. 6(1)(f) GDPR (legitimate interest in securing the service).

8. Local Storage on Your Device

The app stores your arrival history (location, time, parking disc check result) locally on your device. This data is not transmitted to me or to third parties.

You can delete your history at any time within the app. You can also set an automatic retention period in the settings, after which entries are automatically removed.

9. Analytics and Usage Data

To improve the app, anonymous usage statistics may be collected (e.g., which features are used or how often the app is opened). This data does not contain any personal information and cannot be used to identify individual users.

The legal basis is Art. 6(1)(f) GDPR (legitimate interest in improving the service). If an analytics service is used that requires consent, you will be asked for your permission beforehand.

10. Feedback Feature

You can submit feedback about parking spaces through the app, e.g., whether a parking disc is actually required or the maximum parking duration. When submitting feedback, the following data is stored on my server:

  • Your anonymized device ID (the same hash value described in Section 7)
  • The ID of the parking space in question
  • The type of feedback (e.g., parking disc requirement, maximum parking duration)
  • Your optional comment
  • The timestamp of your observation

This data is used to improve the accuracy of parking space information. Submitted feedback is reviewed by me and may be incorporated into the database.

The legal basis is Art. 6(1)(b) GDPR (performance of a contract — improving parking data is part of the app's core function). Feedback records are retained for up to 2 years after processing and then deleted.

11. Payment Data

The app offers a subscription for full functionality. All payments are processed exclusively through Apple (App Store). I have no access to your payment data (e.g., credit card number or bank details). The processing of this data is subject to Apple's privacy policy.

12. No Registration Required

The app requires no sign-up and no user account. No names, email addresses, phone numbers, or other personal contact information is collected by the app.

Your Rights

13. Legal Bases for Processing

Your data is processed on the basis of the following provisions of the GDPR:

  • Art. 6(1)(a) GDPR -- Consent: When you have given explicit consent (e.g., granting location permission on your device).
  • Art. 6(1)(b) GDPR -- Performance of a contract: When processing is necessary to provide the core function of the app (location check upon arrival).
  • Art. 6(1)(f) GDPR -- Legitimate interest: When I have a legitimate interest in the processing (e.g., security of the service, analytics for improvement), provided your interests do not override mine.

14. Access, Rectification, and Restriction

You have the right to obtain free information about the personal data I hold about you at any time (Art. 15 GDPR). You can request the rectification of inaccurate data (Art. 16 GDPR) and the restriction of processing under certain conditions (Art. 18 GDPR).

15. Right to Erasure

You have the right to request the deletion of your personal data, provided there is no legal obligation to retain it (Art. 17 GDPR).

Data stored locally on your device (arrival history) can be deleted by you at any time within the app.

16. Right to Data Portability

You have the right to receive your personal data in a commonly used, machine-readable format or to have it transferred to another controller (Art. 20 GDPR), where technically feasible.

17. Right to Object

If your data is processed on the basis of legitimate interests (Art. 6(1)(f) GDPR), you have the right to object at any time for reasons arising from your particular situation (Art. 21 GDPR). I will then cease processing unless there are compelling legitimate grounds that override your interests.

18. Withdrawal of Consent

If processing is based on your consent, you may withdraw it at any time with effect for the future (Art. 7(3) GDPR). The lawfulness of processing carried out prior to the withdrawal remains unaffected.

In the app, you can revoke granted permissions (location, notifications, motion data) at any time through iOS system settings.

19. Right to Lodge a Complaint with a Supervisory Authority

If you believe that the processing of your data violates the GDPR, you have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The competent authority in Germany is:
